Terms and Conditions of Service

01. Acceptance of Terms & Legal Capacity

These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you (“User,” “Merchant,” “You”) and GetNomics (“Company,” “We,” “Us”). By creating an account, browsing public directories, submitting commercial listings, participating in coin task bounties, or placing orders on GetNomics, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

If you represent a corporate entity, business enterprise, or organization, you warrant and represent that you possess the legal authority to bind that entity to these Terms. If you do not agree with these Terms in their entirety, you are strictly prohibited from using our services.

02. Scope of Services & Architecture

GetNomics is a decentralized commerce directory and local discovery marketplace providing:

• Commercial Directories: Indexed profiles for businesses, service providers, brick-and-mortar storefronts, and independent creators across hierarchical global categories and geographical locations.
• Marketplace Catalogs: Product and service listings with prices, currency attributes, variant matrices (sizes, colors, materials), and stock status indicators.
• Merchant Publication Channels: Editorial articles, industry insights, and guides authored by verified merchants.
• Nomic Coins (NC) Economy: A proprietary utility token mechanism powering promotional advertising campaigns, review bounties, and gift transfers.
• Community Task Hub: A peer-to-peer verification and review platform incentivizing members to evaluate and engage with verified merchant profiles.

03. User Account Registration & Security

To access features such as creating business storefronts, managing coin wallets, writing reviews, and placing order inquiries, you must register a member account. You agree to:

• Provide accurate, authentic, and complete information during registration and keep your profile updated.
• Maintain the confidentiality of your authentication credentials and not disclose your password to any third party.
• Take sole responsibility for all actions performed through your account.
• Immediately notify GetNomics of any unauthorized access, breach of security, or compromised credentials via our Support Desk.
• Never create duplicate or secondary accounts to evade moderator penalties or artificially manipulate promotional incentives.

04. Merchant Listings, Intellectual Property & Licensing

You retain full intellectual property ownership of all logos, product imagery, business copy, and original articles you submit to GetNomics.

By submitting content, you grant GetNomics a worldwide, non-exclusive, royalty-free, transferable license to host, display, index, format, adapt, and distribute your listings across public directories, category indexes, search results, social meta tags, and structured JSON-LD feeds for the operational purpose of promoting and displaying your commercial presence.

You warrant that you possess all necessary patents, trademarks, copyrights, and commercial licenses for any product, brand, or service you advertise on GetNomics.

05. Nomic Coins (NC) Wallet & Financial Escrow Engine

GetNomics integrates a utility coin economy (Nomic Coins). All coin interactions are strictly governed by our double-entry ledger rules:

06. Community Review Tasks & Quality Standards

Members may participate in community review tasks published on the Tasks Dashboard (/dashboard/tasks/):

• Authentic Feedback: Reviewers must provide genuine, constructive, and descriptive evaluations based on actual inspection of the merchant profile or product.
• Anti-Spam Verification: Submissions consisting of generic one-word feedback, spam strings, or bot-generated copy will be rejected by moderators with no coin payout.
• Task Payouts: Upon approval, the allocated reward_per_review is credited directly to the reviewer's wallet balance.
• Zero Collusion: Self-reviewing own businesses, review-trading rings, or automating task submissions will result in immediate permanent account termination and forfeiture of coin balances.

07. Direct Merchant Inquiries & Order Inquiries

GetNomics facilitates direct merchant discovery and shopping cart ordering:

• Order Dispatch: Submitting a shopping cart inquiry (/cart/) dispatches an automated itemized inquiry message to each respective merchant and logs an entry in My Orders.
• Independent Commercial Contracts: Actual physical fulfillment, warranty policies, shipping delivery, and localized payments are executed directly between the buyer and the seller. GetNomics is not a direct supplier, manufacturer, or shipping courier for merchant goods.

08. Prohibited Commercial Conduct & Abuse

Users and merchants are strictly prohibited from engaging in any of the following activities:

• Listing illegal substances, firearms, prescription drugs, stolen goods, or counterfeit merchandise.
• Publishing deceptive, fraudulent, defamatory, or misleading business listings.
• Engaging in artificial click generation, impression manipulation, or bot traffic on sponsored ads.
• Deploying automated scrapers, crawlers (outside compliant search engines), or load injection tools.
• Attempting to exploit financial race conditions, coin balances, or bypass role permissions.

09. Multi-Tier Moderation & Enforcement

GetNomics maintains a dedicated multi-tier moderation console governed by ModeratorCapability standards:

• Capability Gating: Sub-page review actions require verified moderator clearance.
• Full Moderator Boss Authority: Senior moderators possess global assignment authority, cooldown overrides, and batch review capabilities.
• Enforcement Actions: We reserve the absolute right to reject listings, decline advertising campaigns, suspend suspicious transactions, or permanently terminate accounts violating our policies.

10. Payment Gateways, Fees & Taxes

Purchases of Nomic Coins are processed via third-party PCI-DSS compliant payment gateways (Flutterwave & Nova). All pricing is displayed in transparent currency denominations. Merchants are solely responsible for calculating, collecting, and remitting any applicable local sales taxes, VAT, or duties arising from their commercial transactions with customers.

11. DMCA & Intellectual Property Infringement Policy

GetNomics respects the intellectual property rights of creators and copyright holders. If you believe your copyrighted work or registered trademark has been infringed on GetNomics, submit a formal takedown notice to [email protected] with:

• Identification of the copyrighted work claimed to have been infringed.
• Specific URL link(s) on GetNomics identifying the infringing material.
• Your contact information (name, address, email, and telephone number).
• A statement confirming your good-faith belief that the use is unauthorized.

12. Disclaimer of Warranties

THE GETNOMICS PLATFORM, DIRECTORY, SERVICES, AND APIS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, GETNOMICS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE PLATFORM OPERATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETNOMICS, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR COMMERCIAL GOODWILL) ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, OR FROM ANY COMMERCIAL DEALINGS BETWEEN INDEPENDENT MERCHANTS AND CONSUMERS.

14. Indemnification

You agree to defend, indemnify, and hold harmless GetNomics, its officers, directors, and employees against any claims, liabilities, damages, losses, and legal expenses arising from: (1) your breach of these Terms, (2) your infringement of any third-party intellectual property or privacy right, or (3) your commercial products, services, or transactions advertised on the platform.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, and applicable federal statutory law. In the event of any controversy, claim, or dispute arising out of this Agreement, the parties agree to first engage in good-faith informal negotiations through our Legal Operations department for a period of at least thirty (30) days prior to initiating formal arbitration or judicial proceedings.

16. Termination, Severability & Inquiries

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of any remaining provisions. We reserve the right to modify these Terms at any time. For questions regarding this Agreement, contact:
